SC/ST benefits available to Christians reconverting to Hinduism: Kerala HC

KOCHI: A member of a scheduled caste or tribe (SC/ST) who had converted to Christianity from Hinduism can claim the rights and benefits available to SC/ST members if he reconverts, the Kerala High Court has held.

The court's decision assumes much significance in the backdrop of 'Ghar Wapsi' reconversion campaign introduced by the Hindu right-wing group Vishva Hindu Parishad (VHP) last year. Earlier this month, VHP had claimed that it had reconverted over 33,000 persons and had 'prevented' over 48,000 conversions.

It was a petition filed by a father and daughter whose forefathers belonged to Hindu Cheramar community that was considered by the court. Those who approached the court were 46-year-old MA Chandraboss of Ramapuram in Kottayam and his 18-year-old daughter Alida. They were born as Christians as Chandraboss' father had converted to Christianity. In 2009, Chandraboss and his family reconverted to Hinduism by undergoing 'Shudhi Karma' under the auspices of Arya Samaj.

Chandraboss' daughter Alida appeared for the common entrance examination this year and sought admission in the SC/ST quota. However, her claim to SC/ST quota was rejected on the basis of an anthropological report by a state government agency named Kerala Institute for Research, Training and Development Studies (KIRTADS). An appeal filed before the government against this also came to be dismissed.

At the high court, their counsel G Krishnakumar argued that though they had converted to Christianity, they retained the essential character of the caste to which they belonged and suffered the disabilities and disadvantages of other members of their caste.

Opposing the claim, state government submitted that the petitioners, having born into Christianity and having lived as Christians till their reconversion, are to be treated as Christians and not as a scheduled caste member. It is a conversion of convenience, the government counsel argued.

Ruling in favour of the petitioners, justice K Vinod Chandran held, "The 2nd petitioners (Chandraboss' daughter) definitely was brought up in her father's house, may be as a Christian, but a Christian-Cheramar. There being generally no accepted caste discrimination in Christianity, the identity in the Cheramar community was essentially retained."

The court further said in the judgment, "It is to be noticed that Christianity, as it is generally understood, does not have any caste discrimination and the very fact that the 1st and 2nd petitioners (Chandraboss and his daughter) were all along issued with community certificates as belonging to Christian-Cheramar would indicate that they had their origin in the Hindu-Cheramar community. Considering the question of a Christian convert reconverted to Hinduism, this court in Ponnamma's case (Ponnamma vs Regional Director, 1983) held that the child of parents who (had) converted to Christianity at the time of the birth of the child, could always convert back to Hinduism and claim the rights of the caste of her forefathers once she converts back to Hinduism. The rights of a child born as a Christian, to Schedule Caste parents who converted to Christianity, to reconvert to Hinduism and claim the rights available to a Scheduled Caste/Scheduled Tribe, was affirmed by the constitutional bench of the Supreme Court."

Don't Favour SC Quota to Christian and Muslim Dalits: Government

The Government today said it is not in favour of bringing Dalits of Christian and Muslim communities under the ambit of reservation for the Scheduled Castes.

Union Minister for Social Justice and Empowerment Thaawar Chand Gehlot said this during a discussion on a Bill to include more castes under SC category in four states and exclude one from it in Sikkim which was passed by the Parliament today.

"We are not agreeable to it," Gehlot said referring to a demand by some members in the Upper House to include Dalit Christians and Dalit Muslims in reservation for SCs.

Citing a case in the Supreme Court in this regard, the Minister said that discussions can happen based on its outcome.

Responding to demands from several parties on extending reservation in the private sector, Gehlot said this demand has been there for the last 15 years and it would be looked into.

Gehlot was replying to matters raised by members during the discussion on the Constitution (Scheduled Castes) Orders (Amendment) Bill, 2014 which has been passed by the Lok Sabha earlier. Rajya Sabha also passed the Bill by a voice vote with most parties supporting it.

The Bill was first tabled in 2012 but lapsed after the previous Lok Sabha was dissolved and the BJP government introduced it August in Lok Sabha.

Gehlot sought to address members' concerns, saying that diversion of funds from Scheduled Castes Special Component Plan is an important issue and such a practice is not desirable.

Earlier, in the discussion over the Bill, P L Punia (Congress) supported the legislation and said that the population of those in the Scheduled Castes (SCs) and Scheduled Tribes (STs) has increased and the percentage of reservation should also be increased in the same proportion.

Punia advocated extending reservations for these sections in private sector as well as the judiciary.

AIADMK member K Arjunan sought to highlight the demand to include Dalit Christians in the list of Scheduled Castes. Husain Dalwai (Congress) sought reservation benefits for Dalit-Muslims saying discrimination on the basis of caste is not confined to only one religion.

Tarun Vijay (BJP) and D Bandyopadhyay (TMC) supported the Bill. Bandyopadhyay said that the Centre should bring out a comprehensive plan for the development of weaker sections adding that at present efforts only constitute disjointed schemes. Vishambhar Prasad Nishad (SP) and Anil Kumar Sahani (JD-U) also participated in the debate.

BJP member Nanda Kumar Sai demanded strict regulations to eliminate fake community certificates and recording the names of communities in officials records in Hindi and regional languages as well to avoid spelling mistakes.

Dilip Kumar Tirkey (BJD), D Raja (CPI), Ambeth Rajan (BSP), Chaudhary Munavvar Saleem (SP) were among those who shared their views.

NUCF Supports the demand of Dalit Christians for Scheduled Caste Status

The National United Christian Forum (NUCF) comprising of the Catholic Bishops Conference of India (CBCI), National Council of Churches in India (NCCI) and Evangelical Fellowship of India (EFI), strongly supports the just demand of the Dalit Christians and Dalit Muslims who are on hunger strike from 25th-28th July, 2011 at Jantar Mantar, New Delhi. This protest is meant to reiterate the demand for obtaining Scheduled Caste Status to Dalit Christians and Dalit Muslims.



Christians of Scheduled Caste Origin (CSCO), also called Dalit Christians, and Dalit Muslims have been asking for equal Constitutional rights on a par with their fellow Dalit brothers and sisters. Their Constitutional right to be treated equally has been denied historically in the Presidential (Scheduled Caste) Order 1950, Paragraph 3. This exclusion of people of Scheduled Caste (SC) Origin who adhere to religions other than Hinduism, Sikhism and Buddhism from their fundamental rights has caused great concern and has been debated from the very beginning of its promulgation.



The Justice Ranganath Misra Commission for Religious and Linguistic Minorities under the UPA government itself has endorsed that the Dalit Christians and Dalit Muslims should be included in the Scheduled Caste Status and be given the same benefits as their counterparts in other religions. Similarly, the National Commission for Scheduled Castes and National Commission for Minorities have also sent their recommendations in favour of Dalit Christians and Dalit Muslims.



The struggle for Dalit Christians and Dalit Muslims has also received support from several political parties such as BSP, AIADMK, DMK, Telgue Dessam, RJD, LJP, JD(U) CPI, CPI(M). Some members from the Congress Party have also extended their support to the cause of Dalit Christians and Dalit Muslims. However, it is sad and unfortunate that the Central Government has not taken any effective measures yet to address the genuine demand of these sections of Indian society.



The NUCF strongly believes that it is only just and fair that the Christians and Muslims of Scheduled caste origin should get the legal protection and other educational and employment benefits given to their counterparts in other religions. The NUCF is convinced that change of one’s religious faith, does not alter one’s social status in India, and the Dalit Christians and Dalit Muslims in India have been victims of social and economic exploitation for centuries. Their demand is genuine and it needs to be addressed at the earliest so that they can also be on par with Dalit Hindus, Buddhists and Sikhs.
